1. Acceptance of Terms
By accessing or using CryptoGate services ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of the terms, you may not access the Service.
You must be at least 18 years old to use this Service. By using CryptoGate, you represent and warrant that you are of legal age to form a binding contract.
2. Service Description
CryptoGate provides a cryptocurrency payment gateway service that enables merchants to accept Bitcoin, Ethereum, Litecoin, Dash, and Dogecoin payments. Our services include:
- Payment processing infrastructure
- API access for integration
- Dashboard for transaction management
- Webhook notifications
- Technical support and documentation
CryptoGate operates as a non-custodial service. We do not hold, store, or control your cryptocurrency or funds. Payments go directly to your provided wallet addresses.
3. Account Registration and Security
3.1 Account Creation
To use CryptoGate, you must:
- Provide accurate, current, and complete information
- Maintain and update your information
- Maintain the security of your account credentials
- Notify us immediately of any unauthorized access
3.2 Account Responsibility
You are responsible for all activities that occur under your account. You agree to:
- Use a strong, unique password
- Enable two-factor authentication (highly recommended)
- Not share your account credentials with others
- Accept full responsibility for all transactions made using your account
4. Acceptable Use Policy
4.1 Permitted Uses
You may use CryptoGate for legitimate business purposes, including:
- Selling legal goods and services
- Accepting donations for registered non-profits
- Processing payments for digital products
4.2 Prohibited Uses
You may NOT use CryptoGate for:
- Illegal goods or services
- Drugs, weapons, or controlled substances
- Gambling or betting services (unless licensed)
- Ponzi schemes, MLM, or pyramid schemes
- Adult content or escort services
- Stolen goods or counterfeit items
- Money laundering or terrorist financing
- Intellectual property infringement
- Services targeting sanctioned countries
Violation of this policy will result in immediate account termination.
5. Fees and Payment
5.1 Processing Fees
CryptoGate charges a flat 0.8% fee on all processed transactions. Volume discounts available for high-volume merchants (>$50,000/month).
5.2 Network Fees
Blockchain network fees (miner fees) are separate and paid by the customer sending the payment, unless you configure merchant-paid fees.
5.3 Fee Changes
We reserve the right to change fees with 30 days advance notice via email and dashboard notification.
6. Refunds and Chargebacks
Cryptocurrency transactions are irreversible. There are no chargebacks in cryptocurrency. You are responsible for issuing refunds to customers by sending cryptocurrency from your wallet to the customer's address.
CryptoGate does not process refunds on your behalf unless you use our optional hosted wallet service.
7. Intellectual Property
The Service and its original content, features, and functionality are owned by CryptoGate and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.
You may not copy, modify, distribute, sell, or lease any part of our Services without express written permission.
8. Warranty Disclaimer
THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND. WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We do not warrant that:
- The Service will be uninterrupted or error-free
- Defects will be corrected
- The Service is free of viruses or harmful components
9. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, CRYPTOGATE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES.
Our total liability shall not exceed the fees you paid to CryptoGate in the 12 months preceding the event giving rise to liability.
10. Termination
10.1 Termination by You
You may terminate your account at any time by contacting support. Upon termination, your right to use the Service will immediately cease.
10.2 Termination by Us
We may terminate or suspend your account immediately, without prior notice, for:
- Breach of these Terms
- Violation of the Acceptable Use Policy
- Fraudulent or illegal activity
- Requests by law enforcement
- Extended inactivity (>12 months)
11. Indemnification
You agree to indemnify and hold harmless CryptoGate and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:
- Your use of the Service
- Your violation of these Terms
- Your violation of any rights of another
- Your business activities and customer relationships
12. Governing Law and Dispute Resolution
These Terms shall be governed by the laws of [Jurisdiction], without regard to conflict of law provisions.
Any disputes arising from these Terms or the Service shall be resolved through binding arbitration, except that either party may seek injunctive relief in court.
13. Changes to Terms
We reserve the right to modify these Terms at any time. We will notify you of material changes via:
